S.O.S. International is please to present FREE SHOW, a series of interactive works taking place in the corner windows of an apartment building in the landmark district of Weehawken Street. Visible from the Hudson River Park and the West Side Highway, FREE SHOW will feature stie-specific projects by artists who transgress the threshold between the public and private spheres of home and street with interactive exchanges, services and performances.

A big victory: Golan v. Gonzales

The 10th Circuit decided our appeal in Golan v. Gonzales today. In a unanimous vote, the Court held that the "traditional contours of copyright protection" described in Eldred as the trigger for First Amendment review extend beyond the two "traditional First Amendment safeguards" mentioned by the Court in that case. It thus remanded the case to the District Court to evaluate section 514 of the Uruguay Round Agreements Act (“URAA”) under the First Amendment, which removed material from the public domain.

Golan v. Gonzales        

The CIS filed this suit on behalf of a University of Denver, Colorado conductor and others, seeking to have the CTEA and the Uruguay Round Agreements Act declared unconstitutional. The suit challenges Congress’s ability to reclassify works that have already passed into the public domain as copyrighted, thereby giving ownership back to private entities.

The Tenth Circuit handed us a momentous victory today, holding that the Uruguay Round Agreements Act ("URAA") altered the "traditional contours of copyright protection" by resurrecting copyright protection for works that had fallen into the public domain, thus contravening the "bedrock principle of copyright law that works in the public domain remain in the public domain."

While this decision does not invalidate the URAA, it does hold that the URAA must pass either strict or intermediate First Amendment scrutiny on remand.

photography not allowed - get out!
This post over on jameswagner highlights a concern I've voiced before that I personally find problematic: galleries and museums who still restrict the use of photography (I always take my shots without flash, fyi), who fail to understand that bloggers and other networks of individuals now account for a considerable amount of their publicity and general dialogue that was previously restricted to critics and experts (whatever that means).

But James's run-in was more unfortunate, with the gallery staff escalating the incident to a verbal altercation and subsequently leaving nasty comments on James's blog. Tsk tsk.

I restate my previously mentioned proof of concept:
Flickr search for MoMA versus Flickr search for Cooper-Hewitt - the MoMA has over 80,000 images, taken and uploaded by the public, including masses of their collection; the Cooper-Hewitt has just over 1,500, mostly of the facade and building exterior, because photography inside is not allowed.

You'd think that galleries would be ahead of the curve (ahead of the bulky beaurocracy of museums, at least), but I guess some folks get prissy over photography in their shops. Anyways, there are quite a few initiatives by various museums going in the direction of encouraging public photography and subsequent photo-sharing. The "pioneers" among the museums are undoubtedly MoMA and the two artists who developed "iMoma":

A Town Tries to Protect an Artist's Inspiration

TRURO, Mass. — Walking the beaches and dunes of South Truro, it is easy to see how the artist Edward Hopper and countless others were captivated by the scenery, a sweeping expanse of sand and sunlight bouncing off Cape Cod Bay.

Now some worry that the view from Hopper's small whitewashed home is in jeopardy, as well as the home itself. The parcel has become the subject of controversy, with some residents trying to protect what they see as a piece of American artistic history and others defending the right of a property owner to build what he wishes on his land.

In May, Donald and Andrea Kline bought 9.3 acres next to Hopper's house for $6.75 million. They plan to build a house that, with a garage and a pool, is expected to be about 6,500 square feet, according to a sewer application.

Expansive houses dot the dunes here. But the Klines' proposal has angered some residents who say it will sit atop a ridge directly in the "Hopper Landscape," a swath of land visible from a large, north-facing window that allowed into Hopper's home the light he found so captivating. Hopper first came to Truro in 1930 and spent every summer here until his death in 1967. Mr. Kline says the home would be to the right of the Hopper Landscape.

Joan Holt, a Truro resident, opposes construction of the house. "It's a place that has great historical and artistic significance," Ms. Holt said. "Our roots here on the lower cape are with two kinds of people, fishing people and artistic people."

More than 300 residents signed a petition asking the Board of Selectmen to refer the project for further review by the Cape Cod Commission, a regional land use agency.

In September, the board voted, 4 to 1, to ask the commission to consider whether the house would have a regional impact because of historical and environmental concerns. The commission takes up the case on Oct. 4.

Pablo Helguera's School of Panamerican Unrest

The latest gallery foray of conceptual artist Pablo Helguera is, somewhat surprisingly, comprised of small delicate collages. Constructed of images that reflect his travels through the Americas during his project, The School of Panamerican Unrest (SPU), Suite Panamericana–now on view at Moti Hasson Gallery in New York–is only one of the material outputs of this ambitious happening (which also includes a website, blog, and an upcoming documentary). In what is described as a ‘nomadic think tank,’ Mexican-born Helguera and other members of the SPU traveled by car through the Americas, from Anchorage, Alaska to Ushuaia, Argentina making ‘official’ stops along the way. Through performances, workshops, screenings, and discussions the SPU initiated a trade of ideas, devoid of the usual polemics of Pan-American trade and globalization. A public performance by Helguera on Thursday, September 20 at 7:30pm at Moti Hasson will surely illuminate these ideas further.
